Terms and Conditions

These Terms govern (a) the use of the AiSOS GmbH platform and (b) the platform agreement between user and AiSOS GmbH concerning the provision of software-as-a-service offerings. Users may be consumers ( 13 BGB) or entrepreneurs ( 14 BGB). The Platform provides AI-assisted Standard Operating Procedures (SOPs) and is not the provider of external content.

User: Natural or legal person who registers an account on the Platform. Platform: The software-as-a-service solution operated by AiSOS GmbH. SOP: A user-triggered, AI-assisted processing operation (e.g. image, video, text generation, email summarization). Minutes: Billing units used for SOP executions. Artifact: The output of an SOP execution (file, document, image).

By registering, the user submits an offer to conclude a platform contract. AiSOS GmbH accepts the offer by activating the account and sending a confirmation email. The contract takes effect upon receipt of confirmation.

AiSOS GmbH provides a browser- or app-based platform that triggers AI-assisted processing. The scope of services is defined by the current service description. AiSOS GmbH is entitled to adapt the scope of services in the course of technical evolution, provided the changes are reasonable for the user.

The user must provide truthful information at registration. Login credentials must be kept confidential and protected from unauthorized access. The user may not use the Platform for unlawful purposes, in particular not upload or generate content that infringes third-party rights.

Use of the Platform is invoiced under the current price model on a minutes/SOP basis. All prices are in Euro and include statutory VAT. Invoices are provided electronically through the Platform. Payment is processed via the payment service providers integrated into the Platform (e.g. Stripe). In case of payment default, AiSOS GmbH is entitled to suspend access to the Platform.

Consumers have the statutory right of withdrawal pursuant to 355 BGB. You have the right to withdraw from this contract within fourteen days without giving reasons. The withdrawal period is fourteen days from the date of conclusion of contract. To exercise your right of withdrawal, you must inform us (AiSOS GmbH, Schuckertstrasse 1, 71277 Rutesheim, Deutschland, email: info@aisos.com) by means of a clear declaration of your decision. The right of withdrawal expires prematurely if the Platform has fully rendered the service and execution began only after the consumer's express consent.

AiSOS GmbH has unlimited liability for intent and gross negligence as well as under the German Product Liability Act. For slight negligence, AiSOS GmbH is liable only for breach of essential contractual obligations (cardinal duties); liability is limited to the foreseeable damage typical of the contract. Any further liability is excluded. AI-generated outputs do not constitute legal, tax, or medical advice; their use is at the user's own risk.

AiSOS GmbH aims for 99 % platform availability on annual average. Planned maintenance will, where possible, be announced at least 24 hours in advance.

The platform contract is concluded for an indefinite period. Either party may terminate the contract with 14 days' notice to the end of the month. The right to extraordinary termination for cause remains unaffected. Notice of termination must be given in text form (email is sufficient).

The processing of personal data is governed by our Privacy Policy, which forms an integral part of these Terms.

The European Commission provides a platform for online dispute resolution (ODR): https://ec.europa.eu/consumers/odr. AiSOS GmbH is neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration body.

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. If the user is a merchant, legal entity under public law, or special fund under public law, the place of jurisdiction is the registered office of AiSOS GmbH. Should individual provisions of these Terms be invalid, the validity of the remaining provisions shall remain unaffected.
